Article 231 of the French Tax Code bases payroll tax on the remuneration paid, weighted by the liability ratio (receipts giving a right to deduct / total receipts). A recurring question: must a debt waiver received (remission of a commercial or financial debt) be included in the denominator? The Conseil d'État ruling of 17 June 2024 (no. 474155) reversed the prevailing approach: whether income qualifies as financial (or not) is assessed in light of its legal nature, not its accounting treatment. As a result, a waiver booked as financial income, but whose legal nature is that of commercial or operational support, does not enter the base of the liability ratio.
